Scope of Control at the Place of Performance of Remote Work

Streszczenie: Following the Covid pandemic, solutions pertaining to remote working were introduced into the Polish Labour Code, having entered into force on 7 April 2023. Remote work is performed entirely or partially at a place indicated by the employee and agreed with the employer, in particular by means of direct communication at a distance. The employer has the right to control the performance of remote work at the place where it is carried out and also when that takes place at the employee’s place of residence. The purpose of this paper is to analyse the scope of the control that may be conducted at the remote workplace. The inquiry encompasses conducting controls of the employee’s performance of obligations to deliver work, compliance with healthy and safe working conditions, as well as compliance with information and personal data protection requirements. It also discusses the possibilities for conducting sobriety checks on remote workers and monitoring remote work, including monitoring the email communication of an employee who performs work remotely. The article will also draw attention to the limitations of carrying out such controls
